Paperwork Needed to Sell or Buy a Car in Delaware

Selling a car in Delaware requires several documents to ensure a smooth and legal transaction. This guide provides a comprehensive list of the paperwork you'll need, along with helpful links to resources for obtaining the necessary forms and additional information. 

 

1. Vehicle Title 

The most important document when selling a car is the vehicle title. The title must be signed and dated by both the seller and the buyer. If there is a lien on the vehicle, ensure that it has been released.

2. Bill of Sale 

A bill of sale is a document that records the details of the transaction, including the names of the buyer and seller, the sale price, and the vehicle's make, model, year, and VIN. Both parties should sign the bill of sale.

3. Odometer Disclosure Statement 

Federal law requires that the odometer reading be disclosed for vehicles under 10 years old. This can be done on the title itself or on a separate Odometer Disclosure Statement (Form MV-197).

4. Vehicle History Report 

Providing a vehicle history report can build trust with potential buyers by showing the vehicle's accident history, title status, and more. While not mandatory, it is highly recommended. 
You can obtain a vehicle history report from services like Carfax or AutoCheck. 

 

5. Maintenance Records 

If available, provide maintenance records to the buyer. These records demonstrate that the vehicle has been well-maintained and can increase buyer confidence. 

 

6. Release of Liability 

Once the car is sold, you should notify the Delaware DMV by submitting a Release of Liability form. This form releases you from liability for any future incidents involving the vehicle.
